Legal basis of the processing and consequences in case of lack of consent

(ii) For the purposes referred to in point 3, letter c), on the fulfillment of legal obligations to which the Data Controller is subject (pursuant to art. 6, co 1, letter c of the Regulation);
(iii) For the purposes referred to in point 3, letter c) above, on the user’s express consent.
The provision of personal data is strictly necessary for the purposes of carrying out the activities referred to in point 3, letters a) and b), and the user’s refusal to provide and process such data prevents UTOPIA from fulfilling requests for information or provision. of the services offered by the Data Controller.

Methods of processing
The processing of personal data is carried out by means of the operations indicated pursuant to art. 4 of the Code and art. 4, no. 2), of the GDPR and more precisely: collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. The user’s personal data are subjected to both paper and electronic processing and through automated systems.
The data will be processed lawfully, fairly and with the utmost confidentiality, in compliance with the minimum security measures as provided for by the Code and the GDPR.
The data will not be subject to public disclosure or to any fully automated decision-making process.
The data relating to the IP address will be processed exclusively anonymously and for the sole purpose of obtaining anonymous statistical information on the use of the Site and to check its correct functioning.
Data communication
Personal data may be made accessible for the purposes referred to in point 3 above to:

Data Retention and Transfer

a) for the purposes referred to in point 2, letters a) and b), the Data Controller will process personal data for the time necessary to fulfill the request and in any case for no more than 10 years from the provision of the requested service; the Data Controller will update the data already provided and / or renew, upon expiry, its consent to the processing, including the storage of data in the UTOPIA databases;
b) for the purposes referred to in point 2, letter c), the user’s data will be used until deletion by the user and in any case no later than 5 years from the sending of the last communication containing.
The data relating to IP addresses will be deleted immediately after processing.
Rights of the interested party
The user, in his capacity as an interested party, is the owner of the rights referred to in art. 7 of the Code and art. 15 of the GDPR. More precisely, the user:
1) has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form;
2) has the right to obtain the indication:
a) the origin of personal data; b) the purposes and methods of the processing; c) the logic applied in case of processing carried out with the aid of electronic tools; d) the identity of the owner, manager and representative; e) the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as appointed representative in the State, managers or agents;
3) also has the right to obtain:
a) updating, rectification or, when interested, integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those that do not need to be kept for the purposes for which the data were collected or subsequently processed; c) the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment is proves impossible or involves the use of means that are manifestly disproportionate to the protected right;
4) finally, you have the right to object, in whole or in part:
a) for legitimate reasons, to the processing of personal data concerning him / her, even if pertinent to the purpose of the collection; b) to the processing of personal data concerning him for the pursuit of purposes not covered by point 2 of this information.
Also pursuant to art. 15 and ss. of the GDPR, the user also has the right to request, at any time, access to his personal data, the correction or cancellation of the same, the limitation of processing in the cases provided for by art. 18 of the GDPR; to obtain in a structured format, commonly used and readable by an automatic device, the data concerning him, in the cases provided for by art. 20 of the GDPR.
